How many establishments/individuals have PTOs, and the names?
There were 13 Permissions to Occupy (PTOs) issued. However, in 2023, the Department revoked all PTOs issued based on legal opinion
hat it had no legal stance. Currently all previous holders of PTOs are expected to reapply for leases in line with the DWS lease
policy which is a legal document.

2. When will the criteria for future leases be formulated? Will it include a public participation process and environmental impact process?
The Department of Water and Sanitation invited Expressions Of Interest (EOI) from private or public entities who are interested to leasing the State land to obtain access rights to state dams and/or to enter into lease agreements with the Department in terms of the Departmental Lease Policy.
Rationale for the EOI Process
• To ensure transparency, fairness, and competitiveness of the leasing process.
• Provide equal opportunity for all potential applicants – public and private.
• To ensure public participation.
The key criteria outlined in the EOI include, but are not limited to, the following:
• Increased recreational or tourism economic activities,
• Existing local landowners or local communities,
• Local community empowerment impact, and
• Historically disadvantaged individuals.
The EOI is accessible on the Departmental website tender: EOI Notice No; DWS07 0524WTE.
The Department also holds Departmental Dam Management meetings, which interested parties are invited to participate in discussions about leasing state-owned land.
The Department currently has the relevant Chief Directorate(s) in place to conduct on-site investigations around Hartbeespoort. These investigations aim to consolidate environmental impact studies, monitor compliance, and enforce the necessary measures.
3. What are the regulations in a DWS lease agreement at Hartbeespoort Dam regarding liquor licenses, noise control and access control?
• Liquor licenses
The lease agreement, under item 13.3, clearly states that, “The LESSEE shall not be entitled to sell on the SITE any liquor for the sale of which a license is required, unless the necessary license has been obtained from a relevant authority and shall not apply for any such license without the prior written permission of the: Chief Director: Water Resources Infrastructure Operations and Maintenance. This includes the operation of a shop or spaza shop- approval must be obtained from the LESSOR”.
• Noise Control
The lease agreement, under item 14, addresses compliance: with laws, regulations, indemnity and guarantees. Specifically, item 14.1 states that: “The LESSEE shall, for the duration of this lease and at his/her own expense, comply with all laws, regulations, and other legal prescriptions of any competent authorized body regarding the SITE and its environment.”
This provision also encompasses laws and regulations pertaining to noise control.
• Access control
National Water Act 36 of 1998 regarding access
o Section 21 (k): Using water for recreational purposes
o Section 113 of the National Water Act 36 of 1998, refers to access to and use of government waterworks for recreational purposes.
The lease agreement, under item 11.6 stipulates that “Any person visiting the SITE shall comply with the terms of the Regulations as contained in Government Notice R654 of 1 May 1964, as may be amended from time to time, and LESSEE undertakes to brings to the attention of his visitors such regulations and /or prescriptions.
4. The Minister said the Madibeng Municipality is the entity responsible for noise control at Hartbeespoort Dam. However, currently the municipality has no promulgated regulations on noise control in its bylaws. In this case, how will noise complaints be addressed. In the absence of promulgated noise control regulations in the Madibeng Municipality’s bylaws, noise complaints at Hartbeespoort Dam can be addressed through, but not limited to, the following measures:
• Reporting to Local Authorities: Residents and affected parties can report noise complaints to the local police or municipal offices. Although specific noise regulations may not be in place, general laws against disturbances and nuisances can still be invoked.
• Interim Measures: Until formal regulations are developed, the municipality may implement interim measures to address complaints on a case-by-case basis. This could involve conducting assessments of noise disturbances and mediating between affected parties.
• Community Engagement: The municipality can facilitate community meetings to discuss noise concerns and work towards voluntary agreements between businesses operating in the area and residents.
